1. Introduction

Thank you for your interest in our products and services. The protection of your personal data is important to us. In this privacy policy, we inform you about how we collect, process and use your data.

In this privacy policy, we, Noubrain GmbH (hereinafter referred to as “we” or “us”), explain how we collect and otherwise process personal data. Personal data means any information relating to an identified or identifiable person. 

If you provide us with personal data of other persons (e.g. family members, data of work colleagues), please make sure that these persons are aware of this privacy policy and only share their personal data with us if you are allowed to do so and if this personal data is correct.

This is not an exhaustive description; other data protection declarations or general terms and conditions and similar documents may govern specific matters. 

This privacy policy is designed to meet the requirements of the EU General Data Protection Regulation (“GDPR”) and the Swiss Data Protection Act (“DPA”). However, whether and to what extent these laws are applicable depends on the individual case.

The terms used are not gender-specific.

3. Collection and storage of personal data and type and purpose of use

a) When visiting the website:

 

When you visit our website www.noubrain.ch, the browser used on your device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information is collected without any action on your part and stored until it is automatically deleted:

 

  • IP address of the requesting computer

  • Date and time of access

  • Name and URL of the retrieved file

  • Website from which the access was made (referrer URL)

  • Browser used and, if applicable, the operating system of your computer and the name of your access provider

 

The aforementioned data is processed by us for the following purposes:

 

 

  • Ensuring a smooth connection to the website

  • Ensuring a comfortable use of our website

  • Evaluation of system security and stability and

  • for further administrative purposes

 

The legal basis for data processing is Art. 6 para. 1 lit. f GDPR and Art. 31 FADP. Our legitimate interest follows from the data collection purposes listed above. Under no circumstances do we use the data collected for the purpose of drawing conclusions about your person.

b) When using our contact form

 

 


If you have questions of any kind, we offer you the opportunity to contact us using a form provided on the website. It is necessary to provide a valid e-mail address so that we know who sent the request and can answer it. Further information can be provided voluntarily.

 

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 lit. a GDPR and Art. 6 para. 1 lit. a FADP on the basis of your voluntarily given consent.

c) When provided via our website

 

 

When you place an order via our website, we collect the following information

 

 

  • Last name, first name

  • A valid e-mail address

  • postal address

  • Telephone number (optional)

  • Payment information

 

This data is collected,

 

  • to be able to identify you as our customer;

  • to be able to process, fulfill and process your order;

  • to correspond with you;

  • for invoicing;

  • to process any liability claims and to assert any claims against you.

The data processing is based on your order and is required in accordance with Art. 6 para. 1 lit. b GDPR and Art. 6 para. 1 lit. b FADP for the purposes mentioned for the appropriate processing of your order and for the mutual fulfillment of obligations arising from the purchase contract.

4. Disclosure of data

Your personal data will not be transferred to third parties for purposes other than those listed below. We only pass on your personal data to third parties if:

  • you have given your express consent to this (Art. 6 para. 1 lit. a GDPR and Art. 6 para. 1 lit. a FADP),

  • the disclosure is necessary for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data (Art. 6 para. 1 lit. f GDPR and Art. 6 para. 1 lit. f FADP),

  • in the event that there is a legal obligation for the transfer (Art. 6 para. 1 lit. c GDPR and Art. 6 para. 1 lit. c FADP), and

  • this is legally permissible and necessary for the processing of contractual relationships with you (Art. 6 para. 1 lit. b GDPR and Art. 6 para. 1 lit. b FADP).

5. Rights of data subjects

You have the right:

 

  • in accordance with Art. 15 GDPR and Art. 25 DSG to request information about your personal data processed by us. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;

  • in accordance with Art. 16 GDPR and Art. 32 FADP, to immediately request the correction of incorrect or incomplete personal data stored by us

  • in accordance with Art. 17 GDPR and Art. 32 FADP, to request the erasure of your personal data stored by us, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims

  • in accordance with Art. 18 GDPR and Art. 32 FADP, to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful but you refuse to delete it and we no longer need the data, but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR;

  • in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller

  • in accordance with Art. 7 para. 3 GDPR and Art. 6 para. 1 lit. a FADP, to revoke your consent once given to us at any time. As a result, we may no longer continue the data processing that was based on this consent in the future, and

  • to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters. In Switzerland, you can contact the Federal Data Protection and Information Commissioner (FDPIC).

6. Rights of appeal

Sofern Ihre personenbezogenen Daten auf Grundlage von berechtigten Interessen gemäss Art. 6 Abs. 1 lit. f DSGVO und Art. 6 Abs. 1 lit. f DSG verarbeitet werden, haben Sie das Recht, gemäss Art. 21 DSGVO und Art. 21 DSG Widerspruch gegen die Verarbeitung Ihrer personenbezogenen Daten einzulegen, soweit dafür Gründe vorliegen, die sich aus Ihrer besonderen Situation ergeben oder sich der Widerspruch gegen Direktwerbung richtet. Im letzteren Fall haben Sie ein generelles Widerspruchsrecht, das ohne Angabe einer besonderen Situation von uns umgesetzt wird.

7. Data security

We use the widespread SSL (Secure Socket Layer) method in conjunction with the highest level of encryption supported by your browser when you visit our website. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.

 

We also use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
 

8. Topicality and amendment of this privacy policy

This privacy policy is currently valid and was last updated in January 2025.


Due to the further development of our website and offers on it or due to changed legal or official requirements, it may become necessary to change this data protection declaration.
